By using or registering with Romanticity you represent and warrant that:

• You are and must be at least eighteen years of age to use and register for the Services;
• You have not been convicted of a felony nor do you have a criminal record;
• You reside in the United States, Canada, or United Kingdom;
• You will use this website in a manner consistent with any and all applicable laws and regulations.

You agree to use the Service in accordance with the following Code of Conduct:

• You will not post on the Service or transmit to other users, communicate any content (or links to content), or otherwise engage any activity on the Service or through the Service that:
  • Intends to defraud, steal from, or deceive other users on the Service;
  • Contains malicious or disruptive code of any kind that intends to harm or gain access to components or devices, or attempts to use components or devices without authorization;
  • Promotes racism, hatred, bigotry, or physical harm of any kind against a group or individual;
  • Contains video or images of another person without their permission or their legal guardians'permission;
  • Intended to or intends to annoy, harass, threaten, or intimidate other users on the Service;
  • Is defamatory, inaccurate, abusive, obscene, profane, offensive, sexually oriented, obscene, or otherwise objectionable;
  • Solicits gambling or engages in any gambling or similar activity;
  • Uses the Service for chain letter, junk mail or spam e-mails;
  • Is in anyway used for on in connection with spamming, phishing, or similar activities;
  • Violates, plagiarizes or infringes upon the rights of any third party, including but not limited to any copyright or trademark law, privacy or other personal or proprietary rights;
• You will not use the Service to infringe the privacy, property, or any other rights of any person;
• You will not post or transmit any information regarding personal contact information including, but not limited to, e-mail addresses, "instant messenger" usernames, postal addresses, telephone numbers, URLs, or full names through publically posted information.
  
  WE HIGHLY RECOMMEND NOT SHARING THE ABOVE INFORMATION IN PRIVATE MESSAGES AND THAT IF YOU CHOSE TO MEET ANOTHER USER IN PERSON, YOU MEET IN A PUBLIC PLACE, TELL FRIENDS AND/OR FAMILY WHERE YOU ARE GOING AND WHAT TIME YOU EXPECT TO RETURN HOME.
• You will not provide any false, inaccurate, or misleading information on your profile or through private messaging to another user. If your information becomes inaccurate, misleading or false, it is your responsibility to update the information as soon as possible. If the information you provided has been found to be inaccurate, false or misleading, by Us or another user, you will be notified via e-mail. If you have not updated your information on your first login after the e-mail had been sent, your account is subject to deletion.
• If you see a profile that is violation of the Terms in any way, you will report that user using the report link located on that user's profile.
• Your account is for your personal use only. You may not authorize another person or entity to use your account, nor may you transfer your account to another person or entity. You acknowledge that we are not responsible for third party access to your account that results from theft, vandalism, or misappropriation of your account, username, or password.

We give you the ability to share your most recent status update from Facebook or Twitter. By connecting your Facebook or Twitter account you understand that:

• Any status updates you post to Facebook or Twitter will be visible to other users who have also connected their Facebook or Twitter accounts;
• Links or other content or information that you post to your Facebook or Twitter status will not violate the Code of Conduct in this agreement;
• You may prevent your Facebook or Twitter status updates from being visible by adjusting the privacy settings on your user settings page;

We do not conduct background checks on our users; however, we reserve the right to conduct a criminal background check, at any time, using available public records, to confirm you are in compliance with Eligibility Subsection (ii). Profiles that are reported by other users are reviewed for violations of these Terms as soon as they are received. We encourage members to report any Terms violations they come across in order to maintain a positive environment for Romanticity users. We may, at our own discretion, suspend or terminate your access to all or part of the Service at any time, with or without notice, for any reason, including but not limited to, breach of this Agreement. Any fraudulent, abusive, or otherwise illegal activity or activity that may otherwise affect the enjoyment or access of the Service by others may be grounds for termination of your access to all or part of the Service at our own discretion. We are not responsible for the messages or content posted or transmitted by or to users, nor can we review every message or content that is transmitted by users on the Service. We reserve the right, but are not obligated to, delete, move, or edit materials, including but not limited to, public profiles, messages, or images, that we, at our own discretion, deem to violate the Code of Conduct and/or Terms set forth in this agreement or to be otherwise unacceptable. You shall remain solely responsible for your actions while using the Service and for content posted to profiles, messages, or other materials you upload to the Service or its users. THIS SECTION WILL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. YOU UNDERSTAND AND AGREE THAT YOU USE THIS SERVICE (ROMANTICITY.COM) AT YOUR OWN RISK. THERE IS NO WARRANTY. THE SERVICE IS PROVIDED ON AN "AS-IS", "WITHOUT ANY WARRANTY", AND "WITHOUT ANY LIABILITY" BASIS WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, NON-INFRINGEMENT, OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE INCAPABLE OF EXCLUSION UNDER LAW.

WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION PROVIDED ON THE SERVICE, NOR DO WE ADOPT, ENDORSE, OR ACCEPT RESPONSIBILITY FOR THE ACCURACY OR RELIABILITY OF ANY OPINION, ADVICE, OR STATEMENT MADE BY ANY PARTY OTHER THAN ROMANTICITY. UNDER NO CIRCUMSTANCE WILL WE BE RESPONSIBLE FOR ANY LOSS OR DAMAGE RESULTING FROM ANYONE'S RELIANCE ON INFORMATION OR OTHER CONTENT POSTED ON THE SERVICE, OR TRANSMITTED TO OR BY ANY USERS. AT NO TIME AND UNDER NO CIRCUMSTANCES WILL WE ("ROMANTICITY") BE LIABLE FOR ANY INCIDENTAL, SPECIAL, CONSEQUENTIAL OR INDIRECT DAMAGES ARISING OUT OF OR RELATING TO THE USE OR INABILITY TO USE THE SERVICE, INCLUDING, WITHOUT LIMITATION, DAMGES FOR LOSS OR CORRUPTION OF DATA OR PROGRAMS, SERVICE INTERRUPTIONS AND PROCUREMENT OF SUBSTITUTE SERVICES, EVEN IF ROMANTICITY KNOWS OR HAS BEEN ADVISED OF THE POSSIBLITY OF SUCH DAMAGES. UNDER NO CIRCUMSTANCES WILL ROMANTICITY'S AGGREGATE LIABILITY, IN ANY FORM OR ACTION WHATSOEVER IN CONNECTION WITH THIS AGREEMENT OR THE USE OF THE SERVICE, EXCEED THE SUM OF $50.00 (FIFTY) U.S. DOLLARS OR IT'S EQUIVALENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ROMANTICITY BE LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER DIRECT, INDIRECT, GENERAL, SPECIAL, CONSEQUENTIAL, COMPENSATORY, AND/OR INCIDENTAL, ARISING OUT OF OR RELATING TO THE CONDUCT OF YOU OR ANYONE ELSE IN CONNECTION WITH THE USE OF THE SERVICE, INCLUDING WITHOUT LIMITATION, BODILY INJURY, EMOTIONAL DISTRESS, AND/OR ANY OTHER DAMAGES RESULTING FROM COMMUNICATIONS OR MEETINGS WITH OTHER USERS OF THE SERVICE. THIS INCLUDES ANY CLAIMS, LOSSES OR DAMAGES ARISING FROM THE CONDUCT OF USERS WHO HAVE REGISTERED UNDER FALSE PRETENSES OR WHO ATTEMPT TO HARM OR DEFRAUD YOU. You agree to indemnify, defend, and hold harmless Romanticity, and its affiliates, officers, directors, employees, agents, independent contractors, and other partners, for any claims, causes of action, debts, losses, costs, liabilities, and expenses (including reasonable legal fees) relating to or arising, directly or indirectly, out of (a) your use of or inability to use the Sites or Services, (b) your User Content, (c) your violation of any of these Terms or your violation of any rights of a third party, or (d) your violation of any applicable laws, rules, or regulations. Romanticity reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Romanticity in asserting any available defenses. In addition to the free services we provide on the Romanticity website, additional services are offered which require payment for service. Where payment is required, the following additional terms and conditions apply.

Romanticity will use the credit card information you provide to bill you for the Service you choose. By subscribing to the for-fee service and providing your credit card details, you agree to be billed by us for your for-fee service in advance. Romanticity will not share your financial information with third-parties except as necessary to process your payment(s), nor will Romanticity save financial information on its servers. We currently do not offer recurring payments for our services. By providing your credit card details to us, you consent to and authorize us to provide your credit card details to such credit card processors and financial institutions as are necessary to process your payment.

You may request cancellation of any Romanticity services at any time. Where, however, a fee has been paid for a service, all such payments for service is non-refundable. If you believe that any material or content distributed by Romanticity constitutes copyright infringement, please provide us with the following information: an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; a description of the copyrighted work that you claim has been infringed; a description of where the material that you claim is infringing is located on our website; your address, telephone number and email address; a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf. This Agreement represents the entire agreement between you and Romanticity regarding the use of our services and supersedes any other agreement or understanding on the subject matter. If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and be enforceable. This Agreement is not assignable, transferable or sublicensable without the prior written consent of Romanticity. Romanticity may assign this Agreement in whole or in part. No agency, partnership, joint venture, or employment is created as a result of this Agreement.

You acknowledge that we are not responsible for suspension of Service, regardless of the cause of interruption or suspension.

The Service may from time to time contain links to other Internet sites and resources ("External links"). You acknowledge that we are not responsible for, and have no liability as a result of the availability of External Links or their contents. We suggest that you review the terms of use and privacy statements of such External Links prior to using them.

We reserve the right to send electronic mail ("e-mail") to you, for the purpose of informing you of changes or additions to the Service, the Terms, or Privacy Policy. We reserve the right to disclose information about your usage of the Service and demographics in forms that do not reveal your personal identity.
